The Board encourages the planting of appropriate flowers (no vegetables or fruits) in original existing garden beds around the perimeter of your unit and hereby grants unit owners' the right, without Board permission to do so. You may not increase the size of any existing garden bed or create new garden beds on Common or Limited Common areas of the property. Any violator will be required, at his own cost and expense, to remove same and return the area to its original state. In addition, tomatoes may be planted within existing mulched areas on the sides or back of your unit. No tomatoes shall be planted in the front area of any unit. No tomato plants shall be more than four (4) feet in height, and the total planting area for said tomato plants shall not exceed twenty (20) square feet. Unit Owners shall remove the tomato plants from the mulched areas when the growing season for tomatoes has ended and restore the mulched areas to their original condition. Although some of these restrictions may seem unreasonable, they are all keyed to our prevailing landscape contract. Just one example; consider that if owners were allowed to extend their original garden beds? This would require our landscaper to do additional bed edging and provide additional mulch to accommodate the enlarged garden beds. Any changes to our landscaping could have a detrimental effect on the cost of current in-force landscaping contracts. If you would like to replace some or all of the foundation plants, in your original existing garden beds, you must select your plants from a list of Acceptable Foundation Plants specified by our landscape contractor. You must also submit the Foundation Plant Alteration form to the Board for approval. You must have prior written approval from the Board before you begin any such project. If you choose to proceed without written Board approval, you will be required, at your own expense, to remove what you've done and return the area to its original state. If, after notification by the Board, the unit owner does not return said area to its original state, the Board will make the necessary corrections. In such a case, the unit owner shall be assessed all costs associated therewith, including reasonable attorney's fees if applicable.

Foundation Plantings
A word about replacing the shrubs around your unit foundation; as you are aware, the Association is only responsible for trimming existing shrubs. We are aware of the fact that most of the shrubs are 30 years old and have now overgrown the space that they were planted in. Our landscape contractor has provided us with a list of acceptable replacement plants that will not take over the planting areas.
